====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 27-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The present Cr. Revision Application has been filed for setting aside the order dated 01.10.2019 passed by Principal Judge, Family Court, Muzaffarpur in Maintenance Case No. 131 of 2019, by which the petitioner was directed to pay an amount of Rs.5,000/- per month to the opposite party No. 2 till the disposal of the case.
Learned counsel for the State submits that the Court prior to passing the order has granted opportunity to the petitioner and after hearing both the parties reached on the conclusion. He also submits that it is an interim maintenance
Patna High Court CR. REV. No.1437 of 2019(3) dt.27-04-2023 2/2 and final amount shall be fixed upon adducing evidences of the parties.
Upon considering both the parties, this Court is of the opinion that the present Cr. Revision Application has been filed under Section 19 (4) of the Family Court Act, 1984 which categorically states that the High Court shall interfere in case of illegality, propriety and correctness but counsel for the petitioner has raised none of the points.
In this view of the matter, the present Cr. Revision Application stands dismissed.
