====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Kopa P.S. Case No. 138 of 2019 registered for the offence punishable under Section 413, 414, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that only allegation against the petitioner is that petitioner was present at the time of purchase of the stolen car. He further submits that there is no specific allegation against the petitioner and similarly circumstanced co-accused Anand Kumar Mishra has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 72620 of 2019 vide order dated 04.12.2019. He further submits that the petitioner has got no criminal antecedent and he is in jail custody since 07.09.2019.

No.75826 of 2019(2) dt.18-12-2019 2/2 In the facts and circumstances of the case, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate-V, Saran at Chapra in connection with Kopa P.S. Case No. 138 of 2019. (I) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(II) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.

(III) If the petitioner tempers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
