Petitioner in the present case is seeking regular bail in connection with Matihani P.S. Case No. 121 of 2019 registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that in the first information report father of the informant had alleged that this petitioner had allured his daughter with an intention to marry and taken her away in connivance with the persons named in the FIR. He has further alleged that earlier also the petitioner was in touch with the daughter of the informant and he used to talk with her secretly.

Learned counsel submits that the victim girl has come

No.74446 of 2019(2) dt.16-01-2020 2/3 back to her parents and from her statement under Section 164 Cr.P.C. as contained in Annexure '2' to the present application it would appear that though she has alleged that she had gone into the Car on the assurance of the petitioner that he would take her house but then she was forcibly taken away to the house of the petitioner where she stayed for 12 days and ultimately her mother talked on the mobile of this petitioner and thereafter she came there and the victim girl was brought back with her parents. It is submitted that this petitioner is relative of the victim girl and being close relation the victim girl had gone to the house of the petitioner and had stayed there and further that in her statement under Section 164 Cr.P.C. she has not alleged any indecent act against the petitioner.

Learned A.P.P. for the State has though opposed the prayer for bail, however, considering the facts and circumstances of the case and the submission that the petitioner is a close relation of the informant and then the victim girl has stayed in his house for 12 days but no indecent act has been alleged against this petitioner and that she has been restored after her mother talked to this petitioner and parents went to the house of this petitioner, the petitioner being in custody since 18.08.2019, the investigation against him is complete, let the

Case No. 121 of 2019 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai, subject to the condition as laid down under Section 437 (3) Cr.P.C. as under :

(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter, (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
