2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 87 of the BNS and under Section 8 of the POCSO Act.
3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant.
4. It has been argued by the learned counsel for the petitioner that during course of investigation the victim was recovered and she has given her statement under Section 183 of the BNSS wherein she has stated that she was being tortured by her family members. Within two weeks she fled away with the petitioner. She has also performed marriage at temple
Patna High Court CR. MISC. No.88012 of 2024(3) dt.22-03-2025 2/2 Bakhorapur with the petitioner. From there she went to Patna on train and then to Ranchi. She has further stated that she has forced the petitioner to marry otherwise she will commit suicide. The allegation against the petitioner is that he has kidnapped the minor daughter of the informant for the purpose of marriage but from perusal of the statement of the victim it transpires that she herself has has gone with the petitioner. The petitioner is in custody since 05.10.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhobaha P.S. Case No. 60 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge VI, (POCSO Special Court) Ara, Bhojpur.
