The petitioner seeks bail in connection with Naubatpur P.S. Case No. 396 of 2019, registered under Sections 457 and 380 of the Indian Penal Code. The accusation is that in the mid night of 15/1606-2019, on hearing the sound of Khat-Khat, the informant Md. Hussain Mansuri woke up then saw two persons in the house, who were engaged in opening of almirah. On seeing the informant, both persons started fleeing, but on chase one person apprehended, who disclosed his name Md. Amjad (Petitioner). On search, mobile of the informant recovered from the pocket of petitioner.

Learned counsel for the petitioner submits that

No.78517 of 2019(2) dt.03-12-2019 2/2 petitioner and informant are co-villager and next door neighbour and due to grudge and enmity, the petitioner has falsely been implicated in this case. Further submission is that after apprehending by the Police in the present case, he has also been made accused in Danapur P.S. Case No. 490 of 2019, under Section 323 and 447 of the Indian Penal Code, which are bailable in nature.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-II, Danapur in connection with Naubatpur P.S. Case No. 396 of 2019. One of the sureties must be parents/close relative of the petitioner.
