2. The present petition has been filed on behalf of the petitioners, apprehending their arrest, in connection with Konch P.S. Case No. 216 of 2023, dated 15.05.2023, registered for the offences punishable under Sections 341, 323, 307, 504 and 506 read with Section 34 of the Indian Penal Code.
3. As per the allegation, when the informant and his brothers were going somewhere on motorcycle, they were stopped and assaulted by the accused persons, including the petitioners and Rs. 2,000/- and a chain was also snatched from them. The accused persons have also caused head injury to the
Patna High Court CR. MISC. No.84432 of 2024(2) dt.11-12-2024 2/2 informant and his brothers.
4. Ld. counsel for the petitioners submits that the Petitioners are innocent and have falsely been implicated in this case. He further submits there is no specific allegation against any of the petitioners and the present petitioners have no criminal antecedents.
5. It is also stated in paragraph no. 2 of the bail petition that the petitioners have not moved this Court earlier either for anticipatory bail or regular one in the instant case.
6. It has further been stated in paragraph no.3 of the bail petition that the petitioners have no criminal antecedents.
7. Ld. APP for the State vehemently opposes the prayer of the Petitioners for bail submitting that the allegations against the petitioners is serious in nature.
8. Considering the aforesaid facts and circumstances of the case and seeing the nature of the allegation, I am not persuaded to enlarge the petitioners on anticipatory bail.
9. Accordingly, the prayer of the petitioners for anticipatory bail is rejected.
