JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner seeks Regular Bail in connection with Sanokhar (Amdanda) P. S. Case No. 113 of 2019, registered for the offences punishable under Sections 188, 290, 414, 34 of the Indian Penal Code and Sections 30(a), 30(f) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 280 litres of illicit liquor from the dickey of the vehicle in question and two co-accused persons including the person who was driving the said vehicle, is said to have been arrested from the spot and he is said to have disclosed that the said vehicle belongs to the petitioner.

The learned counsel for the petitioner submits that the petitioner was not present in the vehicle and his vehicle was

Patna High Court CR. MISC. No.76210 of 2019(2) dt.25-11-2019 2/2 being driven by the driver, hence, he was not having knowledge about the illicit liquor being carried in the said vehicle. The petitioner stated to be having a clean antecedent and is rotting in jail since 23.10.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on Regular Bail.

Accordingly, the above named petitioner is directed to be enlarged on Regular Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2 Additional Sessions Judgecum-Special Judge, Excise Act, Bhagalpur in connection with Sanokhar (Amdanda) P.
