JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2018 At the very outset, learned APP has pointed out that this is a case of 2002 and process under Sections 82 and 83 Cr.P.C. has been exhausted, as such this application is not maintainable. Petitioner apprehends his arrest in connection with Pear P.S.Case No. 46 of 2002 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. Heard both sides.
In the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
