On confidential information, the informant ASI Rajesh Kumar alongwith police personnel conducted raid at village Nakti wherefrom Munna Besra was apprehended having a gallon containing 15 litres of Mahua wine. During course of returning, they got another confidential information with regard to carriage of huge quantity of wine from Jharkhand over a Bolero jeep and during course of checking, Jeep bearing registration No. JH-027-6631 was apprehended where so many plastic bags were found. On query, the driver Prem Kumar Rai disclosed that the aforesaid plastic bags contained sachets of country made Masaledar wine totalling 1350 pouches, each of 200 ml. which was purchased by the owner of the vehicle,

Patna High Court CR. MISC. No.75307 of 2019(2) dt.26-11-2019 2/2 namely, Bhagwat Yadav. Further more, the informant also disclosed presence of Nand Deo Rai (petitioner) in the aforesaid vehicle. Neither under self statement of the informant any kind of allegation has been attributed nor presence of the petitioner happens to be over the seizure list. Apart from this, para-3 discloses absence of criminal antecedent and further, being under custody since 28.9.2019.

Consequent thereupon, the petitioner, Nand Deo Rai, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Banka in connection with Katoria P.S.Case No. 181/2019. (Aditya Kumar Trivedi, J) Surendra/- U
