JUSTICE SANJAY PRIYA ORAL ORDER 18-07-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Lakhisarai (Kawaiya) P.S. Case No. 454 of 2013 instituted for the offence under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code, Sections 17, 18, 18(B), 21, 38 7, 40 of the unlawful Activities Prevention Act (UAPA).
It is alleged in the written report that police got information with regard to fraud and forgery committed by terrorist group near HDFC Bank. The police on such information reached the place of occurrence and apprehended four persons along with white Scorpio vehicle and recovered various articles from their possession as mentioned in detail in Fard-e-beyan. Patna High Court Cr.Misc. No.35608 of 2018 (3) dt.18-07-2018 2/2 disclosed the name of other accused persons including the petitioner as active members of the aforesaid Gang. Case diary has been received.
Learned A.P.P. has pointed out the confessional statement of co-accused Md. Zubair which is recorded in paragraph-65 of the case diary wherein he has given in detail about various amounts which has been deposited in account of different persons. In his statement he has taken the name of petitioner as acting member of the aforesaid gang. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
