Petitioner seeks bail in G.B. Nagar P.S. Case No.244 of 2019 registered under Sections 413, 414, 307, 353 and 34 of the IPC and under sections 25(1-b)a, 26, 27 and 35 of the Arms Act and under sections 3, 4, 5 of the Explosive Substances Act. The informant got information that some criminals had assembled at the house of Golu Singh and on such information, a raid was conducted in the house of Golu Singh and arms and ammunition were recovered from there. It is further alleged that from almirah of Nanhe Singh (petitioner), some explosive substances were recovered.
Learned counsel for the petitioner submits that the petitioner is the uncle of Golu Singh. The petitioner resides on
Patna High Court CR. MISC. No.77988 of 2019(3) dt.19-03-2020 2/2 the second floor of the house and nothing has been recovered from possession of the petitioner. Golu Singh has got criminal antecedent. The petitioner has got no criminal antecedent and on account of recovery from the house of Golu Singh, who happens to the nephew of the petitioner. The petitioner is in jail since 19.09.2019. The petitioner has already remained in jail for six months.
Having considered the facts and the nature of allegation made against the petitioner and the fact that the petitioner has remained in custody for six months and the petitioner has got no criminal antecedent, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Siwan in connection with G.B.
