2. The petitioner seeks regular bail in connection with Saur Bazar P.S. Case No.332/2023 lodged on 19.06.2023 under Section 147, 148, 307, 323, 341, 354B, 379, 504 & 506 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against 9 named accused persons including the present petitioner alleging therein that all the accused persons assaulted and abused the family members of the informant. It is specifically alleged against co-accused Dharmendra Sah that he tried to commit rape upon the informant.

4. Learned counsel for the petitioner submits that the

From the content of the FIR, it itself appears that the informant and petitioner both are well known to each other and they are agnate. In fact, in the background of construction of house, the dispute started between them. He further submits that the allegation against the petitioner is omnibus and general. Moreover, upon conclusion of investigation, the chargesheet has already been submitted. The petitioner is in custody since 26.06.2023 having no criminal antecedent.

4. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa, in connection with Saur Bazar P.S. Case No.332/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
