2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109(1) and 103(1) of the BNS.
3. As per the prosecution case, the informant alleges that she, along with her family members, had gone to the field when all the accused persons, including the petitioner, stabbed her son, causing injury in his abdomen. It is further alleged that Imranul, Shabnam, and Kyamuddin Kamal assaulted her brother, Wasim Akhtar, with lathi and knife, causing injury to his head. Thereafter, Nazir, Firoz, and Ekbal stabbed Basim Sah, causing injury in his stomach and also cutting two of his fingers. The accused persons then fled, and the injured were taken to the
Patna High Court CR. MISC. No.82099 of 2025(2) dt.02-12-2025 2/2 hospital, however, her son died on the way.
4. Learned counsel for the petitioner submits that specific allegation of assault is against other named accused persons. There is no specific allegation against this petitioner. Petitioner is in custody since 15.09.2025. Charge-sheet has already been submitted. Similarly situated co-accused have already been allowed bail by this Court vide order passed in Cr.Mis.No. 60742/2025.
5. Learned counsel for the informant vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, West Champaran in connection with Gaunaha P. S. Case No. 67 of 2025/ GR No. 1811/2025.
