The petitioner seeks bail in a case registered for the offence under Sections 37(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Section 25(1-b)a/26 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in judicial custody since 20.02.2019. Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioner was arrested in

Patna High Court CR. MISC. No.76707 of 2019(2) dt.18-12-2019 2/2 drunken condition along with two country made pistol and twenty two live cartridges.

Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. According, the prayer for bail of this petitioner is rejected.
