The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 323, 324, 307, 302 and 504 of the Indian Penal Code.

The prosecution case in short is that while the informant was sitting at his house, the accused persons came and started abusing and on protest, they have assaulted the informant his family members.

No.80848 of 2019(2) dt.10-12-2019 2/2 It has been submitted on behalf of the petitioner that the petitioners are in custody since 2.9.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners are members of unlawful assembly. No specific overt act is alleged against the petitioners. No specific injury is attributed against the petitioners. Specific allegation is against the co-accused namely Shamsher and Naushad.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Kopa P.S. Case No. 84 of 2019.
