The petitioner seeks bail in connection with Parsa P.S. Case No. 292 of 2019, registered under Sections 376, 511 and 34 of the Indian Penal Code and 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.
The accusation is that daughter of the informant, aged about 10 years, has gone in field to cut the grass. At that time, Jamadar Singh and Faizuddin (petitioner) reached there. Thereafter, both covered the mouth of his daughter and made attempt to commit rape by unfolding the pant. On raising alarm by her daughter, Priyanshu Kumari, her brother-in-law, Shyam Lal Sah, reached there, then, both fled away. Submission is that the petitioner and the informant are co-villagers and due to dirty village politics, the petitioner and
Patna High Court CR. MISC. No.74642 of 2019(3) dt.17-03-2020 2/2 co-accused, Jamadar Singh, has falsely been implicated. The petitioner has no criminal antecedent and is in custody since 24.08.2019.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Parsa P.S.
