The petitioners are accused in connection with Govindpur P.S. Case No. 177 of 2019, registered under Section 414 of the Indian Penal Code.

The accusation is that in course of checking of the vehicles, two persons were seen on one motorcycle. On giving signal to stop the motorcycle the said motorcycle was stopped. On query, both persons, who were on motorcycle disclosed their names as Shankar Kumar (petitioner no.1) and Sonu Kumar (petitioner no.2) and the papers regarding the ownership of said motorcycle was not produced. Thereafter, petitioner no. 1

Patna High Court CR. MISC. No.76935 of 2019(2) dt.16-01-2020 2/2 disclosed that paper of the said motorcycle has been kept by his brother Bipul Kumar Sah but the room of Bipul Kumar Sah was found locked.

Learned counsel for the petitioners submits that, in fact, the seized motorcycle is belonging to Nityanand Kumar, who is one of the family member of the petitioner, which would appear from annexure 2 to the petition and the application for releasing the said motorcycle has already been filed in the court below. It is further submitted that both petitioners have no criminal antecedent and are in custody since 22.09.2019. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Nawada, in connection with Govindpur P.S.
