2. The petitioner has prayed for bail in connection with Warisaliganj P.S. Case No.311 of 2017 registered for the offence punishable under Sections 409 and 420 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner has withdrawn Rs. 4,00,000/- for Aganwari construction but he has not completed the work.
4. Learned counsel appearing on behalf of the petitioner has submitted that it is the fact that the petitioner has withdrawn the cash and he has also completed the work but he is not having the document showing the completion of work. The learned counsel for the petitioner has submitted that however the petitioner
Patna High Court CR. MISC. No.82144 of 2025(2) dt.09-12-2025 2/2 is ready to pay the alleged amount, subject to the result of the case. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 28.08.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S. Case No. 311 of 2017 with the condition that the petitioner shall deposit the entire amount i.e. Rs. 4,00,000/- within a period of six months after getting released from the custody in six equal installments in a time frame of six months and if he fails to deposit the said amount within the stipulated period, his bail bonds will be cancelled.
