The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 7.2 litres of illegal liquor has been recovered from the passenger Auto vehicle in which petitioner is just a passenger. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 04.10.2019.

In the facts and circumstances of the case, on deposit

Patna High Court CR. MISC. No.77762 of 2019(2) dt.29-11-2019 2/2 of Rs. 2000/- in the Patna High Court Legal Services Committee, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd-cum-Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No. 744 of 2019 arising out of P.R.
