The petitioners seek bail in a case for the offence registered under Sections 302 and 201/34 of the IPC. The prosecution story, in brief, is that on 08.09.2019 at about 8.30 the informant found a dead body of one unknown lady and a bag lying inside her dead body.

It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 10.09.2019. The petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been

Patna High Court CR. MISC. No.74169 of 2019(2) dt.27-11-2019 2/2 implicated in the present case. The petitioners are not named in the F.I.R. Their name has come in the present case merely on the basis of suspicion. There is no eye witness to the alleged occurrence. There is no circumstantial evidence to suggest the implication of the petitioners in the present case. On behalf of the State, it is submitted that the petitioners are not named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Kaimur at Bhabua, in connection with Chand P.S. Case No. 169 of 2019, G.R. No. 1996 of 2019.
