Petitioners apprehend arrest in Bela PS Case No. 180 of 2018 registered under Sections 341, 323, 324, 307, 504 and 506/34 of the IPC.
It is submitted by petitioners' counsel that the parties were at logger head from before due to dispute arising out of a she goat. It is in this context that a free fight ensued which led to lodging of the instant case. All the petitioners are members of one family and have been implicated in this case only to get revenge with the petitioners. In fact the occurrence is otherwise.
Patna High Court CR. MISC. No.76053 of 2019(2) dt.02-12-2019 2/2 Petitioner no. 2 has lodged a counter case (Bela PS Case No. 179 of 2018). it is also pointed out that the prosecution case in respect of assault attributed to the petitioner is belied by the injury report and that the petitioners have no criminal antecedent.
Learned APP for the State opposes the prayer. Considering the aforesaid submissions as also the facts and circumstances of the case, this Court is inclined to allow the petitioners' prayer for anticipatory bail. In the event of arrest or surrender before the court below within four weeks from today, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Sadar Sitamarhi in Bela PS Case No. 180 of 2018 subject to all conditions as laid down in Section 438(2) of the Criminal Procedure Code.
