JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Bithan PS case no. 171 of 2017 instituted for the offences punishable under Sections 307, 379 and other sections of Indian Penal Code.

The allegation in nutshell is that while the informant was going to the market to purchase cap, the accused persons robbed his mobile and Rs. 1200/- and tried to kidnap him but he jumped out of the motorcycle and the accused persons were apprehended by the local people.

The learned counsel for the petitioner submits that the petitioner and one Bikram Kumar, another co-accused are of

Patna High Court Cr.Misc. No.31587 of 2018 (2) dt.31-05-2018 2/2 the nearby village and due to village politics, the petitioner has been falsely implicated. Moreover, the petitioner has no criminal antecedent and he is in custody since 24.10.2017. It is further submitted that the co-accused person has already been granted bail vide order dated 16.04.2018 passed in Cr.Misc. no. 22061 of 2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Samastipur in connection with Bithan PS case no. 171 of 2017.
