The petitioner seeks bail in connection with Galgalia P.S. Case No. 64 of 2025 instituted for the offence under Sections 137(2), 140(3) & 87 of the Bharatiya Nyaya Sanhita, 2023.

Prosecution case, in a nutshell, is that petitioner allegedly kidnapped the mother of the informant. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.09.2025. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.80483 of 2025(3) dt.11-02-2026 2/3 counsel that petitioner has been falsely implicated in the present case. There is delay of two days in lodging the FIR. Learned counsel for the petitioner submits that petitioner never kidnapped the informant's mother rather she left her house and went with the petitioner at her own sweet will. It is next submitted that victim is major and she willingly made consensual relationship with the petitioner, which is evident from bare perusal of the statement of the victim recorded under Section 183 of the BNSS, 2023.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that police after completion of investigation has submitted charge sheet in this case under Sections 69 & 87 of the Bharatiya Nyaya Sanhita, 2023.

Considering the aforesaid facts and circumstances of the case and taking into account the fact that charge sheet in this case is submitted under Sections 69 & 87 of the Bharatiya Nyaya Sanhita, 2023, this Court is not inclined to grant bail to the petitioner at this stage. Prayer for bail is hereby rejected. 8.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.

However, petitioner will be at liberty to renew his prayer for bail in the Court below, if the trial is not concluded within a period of five months from the date of receipt/production of a copy of this order.
