Petitioner seeks bail in Kesariya P.S. Case No.343 of 2019 registered under Section 392 of the IPC. The informant alleged that while he along with his branch manager was returning after collecting money, one Apache motorcycle without registration number dashed against his motorcycle and the miscreants looted away Rs.96,214/- and Samsung Tab from his possession.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The petitioner is said to have confessed his guilt in Kesariya P.S. Case No.344 of 2019 and on the basis of confession of the petitioner, the petitioner is remanded in the case. The petitioner is in custody since 06.09.2019 but he has not been put on T.I.P. Having considered the facts that save and except the confession made by the petitioner, there appears that the Investigating Officer did not collect any tangible material against the petitioner although the petitioner is in jail since 06.09.2019 but he has not been put on T.I.P, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned 3rd A.C.J.M, Motihari, East Champaran in connection with Kesariya P.S. Case No.343 of 2019.
