2. The petitioners have preferred this application for grant of regular bail in connection with Udwantnagar P.S. Case No. 131 of 2024 dated 02.04.2024 registered for the offences punishable u/s 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, On 02.04.2024 at about 6 A.M., the informant along with her family members was harvesting crops in her agricultural field, in the meantime, the petitioners along with eleven others named accused persons came and formed an unlawful assembly. On being instigated by

No. 2311 of 2025(2) dt.24-02-2025 2/3 the co-accused Tez Bahadur Yadav and Bir Bahadur Yadav, all the accused persons started firing indiscriminately upon the informant and her family members but somehow they tried to save their lives due to which Ramdhar Yadav (Father-in-law) was shot in the head and Mukesh Yadav (Brother-in-law) was shot at the back and fell near the canal.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is no specific allegation against the petitioners. There is no forensic and ballistic evidence to substantiate the claims of the petitioners' involvement in the crime. The Petitioner No. 1 has five criminal antecedents whereas the Petitioner No. 2 has one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 16.04.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioners as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two
