JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-04-2019 The petitioner has a grievance that the district administration is attempting to assume possession over a piece of land, which belongs to the petitioner, that has not been acquired. According to the petitioner, some part of his land was acquired in a land acquisition proceeding for the development and beautification of Vishunupad Temple Complex under the Heritage Scheme. However, the district administration is attempting to encroach upon such area of law, which was not subject-matter of the acquisition.
It goes without saying that any land belonging to a citizen can be used for public purpose, either after taking his consent or acquiring the land, in accordance with law.
Patna High Court CWJC No.10678 of 2018(3) dt.12-04-2019 2/2 If the petitioner has grievance that particular area is being attempted to be encroached upon by the district administration forcibly, he shall have liberty to approach the Public Grievance Redressal Officer under the Bihar Right to Public Grievance Redressal Act, 2015, by giving specific details of the land, which has not been acquired and the district administration is attempting to illegally acquire the same, without following any due procedure of law.
This writ application stands disposed of.
