JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioners seek regular bail in connection with Chhauradano (Mahuawa) P.S. Case No. 331 of 2019, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.

Allegation is of recovery of 150.300 litres of Nepali liquor from two motorcycles and petitioners were arrested on spot, however, one persons succeeded in fleeing away. It has been submitted on behalf of the petitioners that they have falsely been implicated in this case having no criminal antecedent and they have been in judicial custody since 24.09.2019 and chargesheet has been submitted.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran, in connection with Chhauradano (Mahuawa) P.S. Case No. 331 of 2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
