The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jhanjharpur P.S. Case No. 97 of 2014, registered for the offence punishable under sections 420, 467, 468, 471, 472, 504, 506 and 120B of the Indian Penal Code.

As per allegation in the F.I.R., the petitioner who happens to be the uncle of the informant, is stated to have sold the land belonging and falling in the share of the father of the informant.

It is submitted by learned counsel for the petitioner that the informant happens to be the own nephew of the

Patna High Court CR. MISC. No.81162 of 2019(2) dt.24-02-2020 2/2 petitioner, who is 70 years old man, having no criminal antecedent. It is further submitted that from the allegation, it would be evident that the dispute is purely a civil dispute and from the order of the learned Court below it would transpire that investigation is still going on.

Having heard learned counsels for the parties, in the facts and circumstances as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of six weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S. Case No. 97 of 2014, subject to the condition as laid down under section 438(2) of the Cr.P.C. (Partha Sarthy, J) sushma/- U T
