JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 91/2019 registered for the offence punishable under Sections 323, 406 and 420 of the Indian Penal Code.

The accusation against the petitioner is that he took heavy amount from the informant for sending informant's brother to abroad for job but when the informant's brother went to abroad, he did not find suitable job and returned after three months and, thereafter, when informant demanded his money from the petitioner, petitioner refused to return the amount. Learned counsel appearing for petitioner submits that as a matter of fact, the informant's brother was send to Doha but he did not like the work, which was provided to him and, thereafter, he returned to his home and after return of informant's

Patna High Court CR. MISC. No.87171 of 2019(3) dt.20-02-2020 2/2 brother, the informant pressurised the petitioner to return the amount and when petitioner refused to return the amount, the informant lodged this false case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Chapra (Saran)/concerned court in Manjhi P.S. Case No. 91/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Spd/- U T
