2. The petitioner in the present writ application has prayed for the grant of following reliefs:- "i. For direction to the respondent authorities to reconsider the candidature of the petitioner for the post of Assistant Professor in the Universities, constituent colleges and government colleges of Bihar in Environmental Science through advertisement no. AP/ENSC-27/20-21

ii. For direction to consider the degree of M.Sc. (Environmental Biology) allied/ equivalent to M.Sc. Environmental Science as the university of Delhi considered both the degrees are equivalent or allied.
iii. For any further relief reliefs, order/orders, direction/directions which are found admissible during the cause of arguments."

During the course of argument it has come to light that after considering the degree and other qualification certificates of the candidates, the Bihar State University Service Commission vide Suchna Sankhya 1489 dated 16.12.2022 published an information through which status of every candidate was shown either as eligible or ineligible. This Suchna dated 16.12.2022 has been brought on record by way of Annexure-P/7. In the said Suchna dated 16.12.2022, the name of the petitioner figures at Serial No. 724 and he has been declared ineligible for the reasons as stated therein. Unfortunately, the petitioner has not challenged this Suchna Sankhya 1489 dated 16.12.2022 and without challenging the same, the petitioner is seeking consequential reliefs.
4. Having realized that this writ application is
Patna High Court CWJC No.19387 of 2025(2) dt.02-12-2025 3/3 misconceived, the learned counsel appearing for the petitioner prays for withdrawing the writ application with liberty to file a fresh writ application in which the petitioner intends to challenge the Suchna Sankhya 1489 dated 16.12.2022 and for seeking consequential reliefs.
5. Learned counsel for the Respondent-State has no objection to the prayed being made by learned counsel for the petitioner.
6. As prayed for, this writ application is dismissed as withdrawn with liberty to the petitioner to file a fresh writ application.
