JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Danapur P.S. Case No. 554 of 2019, registered for the offences punishable under Sections 406, 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.

Prosecution case is that one Sudesh Choudhary executed a sale deed with respect to 10.5 decimals of land in favour of informant with assurance that the land is free from any encumbrances but later it was found that the land is not free from encumbrances.

Submission of learned counsel for the petitioner is that he is only a witness to the sale deed and other co-accused has already been granted bail by a co-ordinate Bench of this Court by order dated 28.11.2019 passed in Cr.Misc.No. 77562

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail on the ground that co-accused, who has been granted bail, has assured that he will return the amount.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Danapur, in connection with Danapur P.S. Case No. 554 of 2019.
