JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2020 Petitioner seeks regular bail in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 589 of 2018 registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected vide order dated 21.05.2019 passed in Cr. Misc. No. 18427 of 2019. There is a recovery of one country made pistol and nine cartridges from the possession of the petitioner and he is an accused of five other cases.

Submission of learned counsel for the petitioner is that he is in custody for about 1 and 1⁄2 years and uptil no single witness has been examined.

No.77341 of 2019(2) dt.19-02-2020 2/2 In view of the submissions as made above, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. 2nd, Bhagalpur in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 589 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area for a period of nine months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the S.S.P., Bhagalpur, for needful.
