1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Bypass Police Station Case No. 240 of 2020, disclosing offences under Section 302, 201, 34 of the Indian Penal Code.
3. As per the FIR, the petitioner called the informant's son on his mobile on 22.07.2020. On the call of petitioner, deceased left his home in order to collect Rs. 10,000/- out of the total loan given by the deceased to the petitioner of Rs. 35,000/-. On 23.07.2020, within one day, the dead body of the informant's son was found in the pond.
4. The prayer for bail of the petitioner was earlier
Patna High Court CR. MISC. No.82398 of 2025(2) dt.28-11-2025 2/3 rejected by this Court thrice. Rejecting the prayer for bail of the petitioner on the third occasion i.e., on 12.09.2025, this court taking into consideration the status report of the Trial Court that case is fixed for argument, rejected the bail application of the petitioner with liberty to renew his prayer for bail after two months.
5. Learned counsel for the petitioner submits that the case was fixed for argument in May 2024, and since then, the prosecution has not started the argument and the case is still pending for argument. Petitioner is in custody since 24.07.2020 i.e., for more than 5 years.

Regards being had to the submissions made by the parties and taking into consideration the submission advanced by the parties and the fact that the case is fixed for argument for more than one year and the petitioner is in custody for more than 5 years, accordingly, I am inclined to grant regular bail to the petitioner.
7. This application is, accordingly, allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned 1st Additional Sessions Judge, Patna City, in connection
Patna High Court CR. MISC. No.82398 of 2025(2) dt.28-11-2025 3/3 to the Bypass Police Station Case No. 240 of 2020.
9. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
