The petitioner seeks regular bail in connection with Ballia P.S. Case No. 215 of 2018, registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the informant and committed a loot of cash of Rs. 2,00,000/- as well as mobile phone and key of the bike.

The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case, as also he was remanded in the present case after he was arrested in connection with Ballia P.S. Case No. 355 of 2018. It is also submitted that neither any

Patna High Court CR. MISC. No.76446 of 2019(2) dt.11-12-2019 2/2 incriminating article has been recovered from the possession of the petitioner nor any Test Identification Parade has been held. Lastly, it is submitted that the petitioner is languishing in custody since 28.5.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Ballia P.S. Case No. 215 of 2018.
