1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Runnisaidpur P.S. Case no. 618 of 2023 registered under sections 413 and 414 of the Indian Penal Code, sections 8 and 20(b)(ii)(B) of the NDPS Act and sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, while 1 kg of ganja and other articles were recovered from the possession of the coaccused, it is stated that four live cartridges were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case because of his antecedent. He is in custody since 20.12.2023 and some

Patna High Court CR. MISC. No.84729 of 2024(2) dt.06-12-2024 2/2 of the co-accused have been enlarged on bail vide order dated 24.4.2024 passed in Cr. Misc. no. 15401 of 2024 and Cr. Misc. no.15738 of 2024 (Annexure- P/2).

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation of recovery of four live cartridges from the petitioner's possession together with the petitioner having remained in custody for 11 months since 20.12.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Runnisaidpur P.S. Case no. 618 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sitamarhi.
