1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in Phulwariya P. S. Case No.181 of 2025 registered for the offences punishable under Section 30(a) of the Excise Act.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of three cases but during the pendency of the instant anticipatory bail application, one more case under the Excise Act was instituted on 23.11.2025, on which learned A.P.P. submits that no useful purpose would be served by considering the instant anticipatory bail of the petitioner for the reason that even if anticipatory bail is granted, still the petitioner cannot surrender as he came to be implicated

Patna High Court CR. MISC. No.80704 of 2025(2) dt.10-12-2025 2/2 in a subsequent case on 23.11.2025 as submitted.

4. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

5. The prayer of the petitioner for anticipatory bail stands rejected.
