The petitioner seeks bail in connection with Bettiah Muffasil P.S. Case No.586 of 2018 registered under Sections 30(a), 31, 35, 38, 41 and 56D of the Bihar Excise and Prohibition Act, 2016.

It is contended by the learned counsel for the petitioner that admittedly no incriminating article was recovered from the possession of the petitioner. The alleged recovery of liquor was from Santosh Patel and Manoj Kumar Patel. The coaccused Santosh Patel and Manoj Kumar Patel have already been granted bail by different Benches of this Court vide orders dated 18.01.2019 and 26.02.2019 passed in Cr. Misc. Nos.6205 of 2019 and 11603 of 2019 respectively. It is further contended that the petitioner is in custody since 22.08.2019 and there is no

Considering the submission made above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran, Bettiah in connection with Bettiah Muffasil P.S.
