In this case, the petitioner is seeking regular bail in connection with Khagaul P.S. Case No.104 of 2019 registered for offence punishable under section 394/34 of the Indian Penal Code.

Allegation has been made that the accused persons intercepted, assaulted and took the mobile of the informant and while they were taking his motor cycle, police came, but they succeeded to flee away from there.

The learned counsel for the petitioner submits that the petitioner having no criminal history, is in custody since 10.06.2019 and he has further placed reliance on the order passed by this Court in Cr. Misc No.56360 of 2019, Aditya

Patna High Court CR. MISC. No.75161 of 2019(2) dt.25-11-2019 2/2 Kumar vs. State of Bihar, wherein the Court has granted bail on the ground that the name of Aditya Kumar transpired on the statement of one Bamveer Yadav, but here Bamveer Yadav is the present petitioner so the said order is not applicable in the present case.

In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner will have liberty to renew his prayer after completion of nine months of jail custody. (Shivaji Pandey, J) Mahesh/- U T
