JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Mansi P.S. Case No. 171 of 2019 dated 05.07.2019 instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act, 2016.

Five litres of liquor is stated to have been recovered from a field and the petitioner has been identified by the police party fleeing away from the place of raid.

It has been submitted on behalf of the petitioner that he has clean antecedents. He therefore submits that no offence under the Excise Act can at all

Considering the clean antecedents of the petitioner and no recovery from his possession, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Mansi P.S. Case No. 171 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
