JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Excise Case No. 682 of 2019 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Recovery of 2,000 liter of illicit liquor from the chamber of a truck Tata 407 and the petitioner is said to be the driver of the Truck.

Submission of learned counsel for the petitioner is that he does not know about carrying of liquor in the truck and he is in custody for about one and half months. He has no criminal antecedent.

Heard learned A.P.P. for the State who opposed the prayer for bail on the ground of huge recovery from the truck

Patna High Court CR. MISC. No.74966 of 2019(2) dt.11-12-2019 2/2 and the petitioner was the driver of the said truck and he was arrested from there.

Having heard both sides, in view of the recovery, I am not inclined to grant bail to the petitioner at this stage. However, once the charge is framed against him, he is at liberty to renew his prayer for bail, on the basis of the material available on record.
