2. The petitioner seeks bail in a case registered for the offence punishable under Section 363 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

3. As per prosecution case, this petitioner is alleged to have fled away with the minor daughter of the informant.

4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. It is next submitted that the victim in her statement recorded under Section 164 Cr.P.C. has denied the prosecution case and claimed her age to be 20 years. Petitioner is in custody since 04.09.2023 and claims clean antecedents.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.308 of 2024(3) dt.21-03-2024 2/2 opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, statement of the victim recorded under Section 164 Cr.P.C. and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VIth-cum-Spl. Judge POCSO, Buxar, in connection with Buxar Town P.S. Case No. 449 of 2023.
