The petitioner is in custody since 13.03.2018 in connection with Gardanibagh P.S. Case No. 93 of 2018 for the offence registered under Sections 420, 417, 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been taken into custody on mere suspicion as it is alleged that the signature of biometric process do not match with the thumb impression at the physical Fitness Test. It is further submitted that several similarly situated co-accused persons have been extended the privilege of regular bail vide order dated 19.04.2018 passed in Cr. Misc. No. 21944 of 2018. It is further submitted that one coaccused, namely, Vishal Kumar has also been extended the privilege of regular bail vide order dated 13.06.2018 passed in Cr.

Patna High Court Cr.Misc. No.33781 of 2018 (3) dt.28-06-2018 Misc. No. 32425 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- cum-Sub Judge XIV, Patna in connection with Gardanibagh P.S. Case No. 93 of 2018.
