The petitioner is in custody since 22.10.2019 in connection with Sp. Case No. 5988 of 2019 (arising out of P.R. Case No. 148 of 2019 for the offence registered under Sections 30(a)/ 32(1)/32(2)/ and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the newly constructed building which does not belong to the present petitioner. It is further submitted that the petitioner was in custody in connection with another case in which he has already been granted bail and from the said case he has been remanded in connection with the present case.
