The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 379 and 120 B of the Indian Penal Code.

As per the allegation in the FIR, she buffalo of the informant were said to have been stolen. It is further stated that earlier also similar theft had taken place under the guidance of this petitioner.

It is submitted by learned counsel for the petitioner that besides the vague and unsubstantiated allegation, as it would be evident from reading of the FIR, there is no material against the petitioner. It is further stated in paragraph 9 of the application

Patna High Court CR. MISC. No.79554 of 2019(2) dt.04-12-2019 2/2 that no incriminating article has been recovered from the possession of the petitioner who has no criminal antecedent. Having heard learned counsel for the parties and taking into consideration the facts and circumstance of the case, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Barahiya P.S. Case No. 151 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai subject to the conditions as laid down in section 438

(2) of Criminal Procedure Code.
