JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-03-2020 The petitioner, who is in custody since 17.04.2019, seeks bail in connection with N.H. Bangra P.S. Case No. 25 of 2019, dated 16.04.2019, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

It appears that 3474 litres of liquor has been recovered from in front of the house of the petitioner. Learned counsel for the petitioner has submitted that he is not the exclusive owner of the house. It is precisely for this reason that his father/Ram Lalit Mahto has

Patna High Court CR. MISC. No.78986 of 2019(3) dt.17-03-2020 2/2 also been made accused in this case. Aforesaid Ram Lalit Mahto has been granted bail by a Bench of this Court vide order dated 18.06.2019 passed in Cr. Misc. No. 35887 of 2019.

Learned counsel for the petitioner has informed this Court that charges in this case has already been framed on 22.07.2019 but till date, not a single witness on behalf of the prosecution has been examined.

Considering the period of custody of the petitioner and other attendant facts, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District Judge-IICum-Special Judge, Excise, Samastipur in connection with N.H. Bangra P.S. Case No. 25 of 2019.

The application stands allowed.
