KUMAR ORAL ORDER 23-08-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner, who is in custody, seeks bail in connection with Pusa P.S. Case No. 96 of 2017 registered for the offences punishable under Sections 201and 304(B)/34 of the Indian Penal Code.
Allegation against the petitioner is that petitioner is the husband of deceased Sangeeta Kumari and he along with other FIR named accused persons killed the daughter of the informant due to non-fulfillment of demand of dowry and disappeared the dead body of the deceased.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Deceased died due to illness as cardio Failure during course of
Patna High Court Cr.Misc. No.37200 of 2018(4) dt.23-08-2018 2/2 treatment. He has no criminal antecedent and he is in custody since 07.03.2018.
Learned counsel for the informant has vehemently opposed the prayer for grant of bail to the petitioner. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Samastipur in connection with Pusa P.S. Case No. 96 of 2017.
