JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Murliganj P. S. Case No. 244 of 2019 registered for the offences punishable under Sections 279, 337, 338, 341, 323, 307, 379, 34 of IPC.

As per prosecution case, the informant was coming from the motorcycle, some accused persons assaulted him and so far this petitioner is concerned, it is stated that later on, he also came along with some unknown persons have assaulted and also snatched the golden chain from his neck and ear ring. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and there is general allegation against him, he is in custody for more than four months, having no criminal antecedent.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Madhepura, in connection with Murliganj P. S. Case No. 244 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
