The petitioners seek bail in connection with Special Excise Case No.491 of 2019 corresponding to Nauhatta P.S. Case No.96 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case on basis of suspicion. Petitioners were neither arrested with the recovered article nor had any concern with the recovered articles. Nothing was recovered from the conscious possession

Patna High Court CR. MISC. No.79932 of 2019(2) dt.18-01-2020 2/2 of the petitioners. Petitioners have no criminal antecedent. Petitioners are in custody since 08.10.2019.

Considering the facts and circumstances of the case, let the, above named, petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act) at Saharsa in connection with Special Excise Case No.491 of 2019 corresponding to Nauhatta P.S. Case No. 96 of 2019.
