Petitioner, apprehends his arrest in connection with Araria Mahila P.S. Case No. 72 of 2019 registered for the offences punishable under Sections 376 of the Indian Penal Code and Section 4 of POCSO Act.
Informant in her written complaint has stated that she received information that her daughter and petitioner are found to have been in compromising position and thereafter attempt was made for marriage of both but same could not be finalized on account of demand of dowry.
It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.75600 of 2019(2) dt.26-11-2019 2/2 that he is innocent and has been falsely implicated in this case. It has been submitted that no offence under Section 376 is made out. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Araria, in connection with Araria Mahila P.S. Case No. 72 of 2019, Special POCSO Case No. 32 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure subject to verification that petitioner has no criminal antecedent.
