JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 28.12.2017 in connection with Pirpainty P.S. Case No. 275 of 2008 for the offences under Sections 452, 324, 307, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is a labourer and, as such, he has not aware of the present case and when he returned to his native place, he was arrested on 28.12.2017.

In view of the fact that the petitioner has remained in custody for nearly six months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions

Patna High Court Cr.Misc. No.33023 of 2018 (2) dt.07-06-2018 2/2 Judge-V, Bhagalpur in connection with Sessions Trial No. 59 of 2018, arising out of Pirpainty P.S. case No. 275 of 2008 with the condition that the petitioner will extend full co-operation in the trial and will appear on each and every date fixed in the case, failing which the Trial Court is directed to cancel the bail bonds of the petitioner, if there is no cogent reason explained for nonappearance.
